Failed NY dental chain lists zero assets, $3.6 million liabilities; it closed ...

BUFFALO, N.Y. — A New York dental chain that closed offices in 13 states without warning late last year listed no assets and liabilities of $3.6 million in a bankruptcy filing posted online Tuesday.

Allcare Dental Management Inc. filed for Chapter 7 liquidation this month in U.S. Bankruptcy Court in Buffalo. The filing shows the suburban Buffalo-based company owns no real estate and has no cash on hand.

A notice to former patients said Allcare and 14 related companies have been liquidating assets since going out of business and attempting to collect money owed to them from patients and insurance companies. That will continue in Chapter 7, the notice said.

Allcare abruptly shut down all its offices at the end of 2010, saying it had run out of money and was unable to obtain enough new financing or equity investments to stay in business.

The closing stunned patients who learned of the situation from notices posted on the doors when they arrived for appointments. Dental records and unfinished work, some of which patients had paid for in advance, eventually were transferred to other dentists.

Allcare said at the time it couldn’t warn patients of the closing because its phone and computer service had been shut down.

Patients in several states have sued. The affected states include Illinois, Iowa, Massachusetts, Michigan, New Hampshire, New York, North Dakota, Nebraska, Ohio, Pennsylvania, Tennessee, West Virginia and Wisconsin.

Chief U.S. Bankruptcy Judge Carl Bucki has instructed potential creditors in the bankruptcy case to refrain for the time being from filing claims, Allcare said.

“He has directed that if it is determined at some future date that sufficient assets have been collected to permit a distribution to creditors, then notice will be sent” to creditors, the posting to patients said.

Additional details about the bankruptcy filing are expected at a creditors’ meeting scheduled for Dec. 12.

Customers can opt to take the coverage or decline the coverage if the renter already has personal coverage. If the renter decides to opt out of the coverage they will be asked to sign a waiver. The 3 different types of coverage’s that are offered include collision, liability and personal accident insurance. There may be some states that may require you to take on certain coverages. The different types of rental coverage’s include:

Collision damage: Protects the renter from damages or if the vehicle is stolen. Supplemental Liability protection: Protecs the renter from lawsuit in the event they cause an accident. Personal Accident Insurance: Provides medica and death benefits if the driver or passenger is involved in an accident.

When a person is involved in a rental accident the very first thing they should is contact the police or call 911. It will also be important that if you’re in the position of collecting information you gather the full name, address, telephone number, insurance information and driver’s license number of the other driver involved in the accident. If there are witnesses you should also try to gather their contact information.  It would also be a good idea to take photos of the car accident and the scene of the accident. A rental car accident can be scary because usually the renter doesn’t understand the process. Most people that are involved in rental auto accidents are on vacation or business travel. A person may not understand what steps to take. When you are involved in a rental car crash, you should handle it the same way you would handle any type of motor vehicle accident. You should always consider contacting an attorney. Every year, millions of tourists and business professionals rent cars. Unfortunately, accidents occur because renters are distracted by scenery, unfamiliar roads and streets, hazardous weather conditions, and other drivers. Accidents also occur because vehicles aren’t properly inspected leading to faulty handling, faulty parts, defective tires and cars that are under maintained. The fact is that there may be several parties that are responsible for an accident. You may be liable, the other driver, the rental company or a manufacturer.
